Terms of Service

These Terms of Service (the "Terms") form a binding legal agreement between you ("you", "your", or the "User") and BeRoyal LLC, a United Arab Emirates company that provides the Service under the trading name FluxWriter ("FluxWriter", "we", "us", or "our"), the operator of the FluxWriter AI SEO content automation platform available at fluxwriter.com (the "Service"). These Terms govern your access to and use of the Service, including our website, applications, APIs, dashboards, and all related features, content, and documentation.

Please read these Terms carefully. By creating an account, clicking to accept, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Disclaimer, and, where applicable, our Affiliate Program Terms, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.

If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" refer to that entity. Certain features, payment flows, and optional add-on services are provided through third parties and are also subject to those third parties' terms, as described below.

1. Definitions

In these Terms, the following capitalized terms have the meanings set out below. Other defined terms appear throughout the document and have the meanings given where they first appear.

2. Eligibility and Accounts

Eligibility. To use the Service, you must be at least 18 years old and able to form a legally binding contract under applicable law. The Service is intended for business and professional use and is not directed to, and we do not knowingly provide the Service to, children under 18. We do not knowingly collect personal information from children under 16. By using the Service, you represent and warrant that you meet these eligibility requirements and that your use of the Service complies with all laws and regulations applicable to you.

Registration. Access to most features requires you to create an Account. Account registration and authentication are provided through our identity provider, Clerk. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You may not create an Account using false information, impersonate any person or entity, or register on behalf of someone without authorization.

Account security. You are responsible for safeguarding your Account credentials and for all activity that occurs under your Account, whether or not authorized by you. You agree to use a strong, unique password, to keep your credentials confidential, and to notify us immediately at legal@fluxwriter.com if you suspect any unauthorized access to or use of your Account. We are not liable for any loss or damage arising from your failure to protect your credentials.

One person, multiple authorized users. Depending on your Plan, you may be permitted to invite additional authorized users to your Account. You are responsible for the acts and omissions of all users you authorize, for ensuring they comply with these Terms, and for any User Materials they submit. You remain the party responsible for the Account and for all fees incurred under it.

3. Description of the Service

FluxWriter is an AI-powered SEO content automation platform. The Service enables you to generate SEO-optimized articles and related media and to automatically publish that Content to your Connected Sites, including WordPress, Shopify, Wix, Webflow, Ghost, and custom webhook destinations.

The Service includes features that may, depending on your Plan and configuration, allow you to:

Certain advanced features are limited by Plan. Google Search Console integration is included on the Pro and Agency Plans. Competitor gap analysis and AI-visibility analysis are available only on the Agency Plan. None of these three features are included in the Free or Starter Plans. The specific features, quotas, and limits applicable to each Plan are described on our pricing page and within the Service, and may be updated from time to time as described in Section 14.

No guaranteed outcomes. The Service is a tool to assist you in producing and distributing content. FluxWriter does not guarantee any particular SEO result, search ranking, indexing, traffic, lead, conversion, sales, or revenue outcome, and results vary from site to site. The only outcome we guarantee is the DA 60 guarantee for the Domain Authority Boost described in Section 11. Search engine behavior, ranking algorithms, and indexing decisions are controlled by third parties and are outside our control. See the Disclaimer for additional important information.

4. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct, your User Materials, your Generated Content, and your use of Connected Sites. The following list is not exhaustive, but you agree that you will not, and will not permit any third party or authorized user to:

Your responsibility for content review. Because the Service produces AI-generated output, you are solely responsible for reviewing, editing, fact-checking, and approving all Generated Content before it is published, and for ensuring that all Content complies with these Terms, applicable law, and the policies of your Connected Sites. We may, but are not obligated to, monitor or review User Materials or Generated Content. We reserve the right to remove, disable, or refuse to process any content that we reasonably believe violates these Terms or applicable law, or that may expose FluxWriter to liability. We may suspend or terminate your Account for fraud, abuse of the Service, or a chargeback, as described in Sections 8 and 15.

5. User Materials and Connected Sites

Your User Materials. You retain all rights in the User Materials you provide. You grant FluxWriter a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and use your User Materials solely as necessary to operate, maintain, secure, and improve the Service and to provide the features you request, including transmitting the topics and keywords you supply to our AI Subprocessors to generate Content, and, where house-style learning is on for a site, your feedback on and edits to Generated Content for that site, to tailor that site's future Content. We do not sell your personal data, and we do not use your data to train AI models.

Connected Site credentials. When you connect a Connected Site, you authorize FluxWriter to access that site using the credentials, tokens, or API connections you provide, and to publish, schedule, update, and manage Content on your behalf as directed through the Service. Connected-site credentials are encrypted at rest. You represent and warrant that you own or are authorized to connect each Connected Site and to grant FluxWriter the access necessary to perform the requested actions.

Third-party host policies. Each Connected Site is operated by you and/or governed by the terms and privacy policies of its host (for example, WordPress, Shopify, Wix, Webflow, or Ghost). FluxWriter is not responsible for the availability, behavior, security, or policies of any Connected Site or its host. Your use of a Connected Site is between you and that host, and you are responsible for complying with the host's terms when publishing Content through FluxWriter.

Accuracy and authorization. You are responsible for the accuracy of the User Materials you submit and for maintaining valid authorization to publish to your Connected Sites. You warrant that you own or have the rights to the topics, keywords, instructions, sample texts, and other User Materials you supply, and that our use of them as you direct does not infringe anyone's rights. If your authorization is revoked or your credentials change, you are responsible for updating them within the Service; FluxWriter is not liable for failed publishing, missed schedules, or other issues resulting from invalid, expired, or revoked credentials.

6. AI-Generated Content and Ownership

Ownership of Generated Content. As between you and FluxWriter, and to the maximum extent permitted by applicable law, FluxWriter claims no copyright or other ownership interest in the Generated Content delivered to you. You own the Generated Content you produce through the Service, and you are fully and solely responsible for reviewing, using, publishing, and distributing it. You assume all responsibility and liability arising from your use of the Generated Content.

Nature and limitations of AI output. Generated Content is produced by automated AI systems and may be inaccurate, incomplete, outdated, biased, or non-original, and similar or identical output may be generated for other users. AI systems can "hallucinate" facts, citations, statistics, and other details. FluxWriter does not warrant that Generated Content is accurate, original, non-infringing, fit for any particular purpose, or compliant with any law, standard, or third-party policy. You must independently review, verify, and edit Generated Content before relying on or publishing it.

Your responsibility. Because you own and control the Generated Content, you are responsible for ensuring it does not infringe third-party rights, is not misleading or unlawful, complies with disclosure requirements (including any obligation to disclose AI-generated content where required), and is appropriate for your audience and jurisdiction. FluxWriter does not screen Generated Content for regulatory compliance, disclosure or labeling obligations, or statements that may trigger FTC, FDA, SEC, or other regulatory scrutiny, and you are solely responsible for ensuring your Content complies with all applicable disclosure, labeling, advertising, and consumer-protection laws before publishing. FluxWriter disclaims all liability for the consequences of publishing or relying on Generated Content. See the Disclaimer for further detail.

AI processing and privacy. To generate Content, the Service transmits to our AI Subprocessors the topics and keywords you supply, the facts about your business that you enter, your saved lessons and rewrite feedback, that site's house rules, and, where you choose to use those features, the brand-voice sample posts, pasted sample text, or existing article you ask us to work from. When you use the in-app assistant, we also send a snapshot of your account context (such as your Plan, connected sites, recent posts and schedules) so it can answer your question, and we retain a short summary of your recurring preferences to keep it useful across conversations. Where house-style learning is on for a site, the data described in the Privacy Policy is also processed to write that site's house rules. FluxWriter does not train AI models on your data and does not sell your personal data. For the full description of what is sent and to whom, see the Privacy Policy.

7. Plans and Subscriptions

FluxWriter offers the following Plans, with features and limits as described on our pricing page and within the Service:

All prices are stated in U.S. dollars (USD) and are exclusive of any applicable taxes unless otherwise indicated at checkout. Paid Plans may be billed monthly or annually, in advance, depending on the billing cycle you select. We may add, modify, rename, or discontinue Plans and adjust Plan features, quotas, and pricing as described in Section 14; changes to recurring fees will be communicated and applied in accordance with that section.

Upgrades and downgrades. You may upgrade or downgrade your Plan through the Service or through the billing portal. Upgrades generally take effect immediately, and downgrades generally take effect at the start of your next billing cycle, unless otherwise indicated at the time of the change. Plan changes may affect the features, quotas, and limits available to you.

When you upgrade mid-cycle, the upgrade takes effect immediately and you will be charged, via Paddle, a prorated amount for the remainder of the current billing period at the new Plan's rate; your next renewal is then billed at the full new Plan rate. Downgrades take effect at the start of the next billing period, and no refund or credit is given for the unused portion of the higher Plan. Quota you have already consumed in a billing period is not restored, credited, or refunded when you downgrade, and we may pause or remove scheduled work that would exceed your new Plan's limits. Repeatedly upgrading and then downgrading, or otherwise changing Plans, to obtain higher-tier features or capacity without paying the higher-tier rate is an abuse of the Service and may result in suspension or an additional charge for the value obtained.

8. Billing, Auto-Renewal, Taxes, Refunds, and Cancellation

Paddle as Merchant of Record for subscriptions. Subscription payments by card are sold and processed by Paddle, which acts as the Merchant of Record (the reseller and seller of record) for those transactions, as it does for any other purchase you make through Paddle's checkout. This means that when you buy a paid Plan by card, your contract for that purchase is with Paddle as reseller, and Paddle handles checkout, invoicing, the calculation and collection of VAT, GST, sales tax, and other applicable taxes, and the processing of any refund of that payment that the law or Paddle's Buyer Terms require. Those purchases are also subject to Paddle's Buyer Terms, which apply alongside these Terms. FluxWriter never stores your full card details.

One-time card payments through Ziina. One-time card payments, such as a deposit into your Prepaid Balance, are processed by Ziina, a payment provider. For those payments FluxWriter is the seller and Ziina processes the payment on our behalf: you pay on Ziina's secure payment page, and FluxWriter never receives your full card details.

Cryptocurrency payments. Where offered, optional cryptocurrency payments are processed by Cryptomus. FluxWriter never stores your crypto payment credentials. Cryptocurrency transactions may be subject to Cryptomus's terms, network fees, and confirmation times, and are generally irreversible once submitted to the relevant blockchain network.

Authorization and auto-renewal. By purchasing a paid Plan, you authorize Paddle (or, for crypto, the applicable processor) to charge the applicable fees and any taxes to your selected payment method. Paid Plans renew automatically at the end of each billing period (monthly or annually, as selected) at the then-current rate, and your payment method will be charged for each renewal, until you cancel. You may cancel auto-renewal at any time through the Service or the billing portal; cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that period ends. A paid Plan bought other than through a checkout we opened for that Plan (for example through a checkout opened outside FluxWriter, or by changing what one of our checkouts was opened for) may be stopped from renewing: we may cancel it from its next billing period, and if we do, you keep it until the end of the period you paid for.

Taxes. Prices are exclusive of taxes unless stated otherwise. Any VAT, GST, sales, use, or similar taxes applicable to purchases made through Paddle's checkout are calculated and collected by Paddle as Merchant of Record and added at checkout where required. You are responsible for any taxes associated with your purchases that are not collected by the applicable processor, other than taxes based on FluxWriter's net income.

No Refunds Policy. All sales are final and all payments are non-refundable: Plans and their renewals, deposits into your Prepaid Balance, Backlink Services, the Domain Authority Boost, and any service we offer in the future. We do not give refunds or credits for partial billing periods, unused post quota or features (unused posts do not carry over to the next billing period), unspent Prepaid Balance, downgrades, or purchases you no longer want. The only exceptions are these:

How refunds are paid. Refunds go to your FluxWriter balance (your Prepaid Balance) unless the law requires otherwise or, for a payment made through Paddle's checkout, Paddle's Buyer Terms do. Only two refunds go back to the way you paid: a genuine duplicate charge, which is refunded to the card or other payment method it was taken from, through the provider that processed it (Paddle or Ziina) for a card payment, or as described below for a cryptocurrency payment; and a Domain Authority Boost bought through a card or cryptocurrency checkout before Boosts were paid for from the Prepaid Balance, which is refunded the way it was paid (Section 11). A refund never includes bonus balance or promotional credit, which is never refundable. Your Prepaid Balance has no cash value and cannot be withdrawn or transferred (Section 11). Cancelling a Plan only stops its next renewal and does not refund the current period (see Cancellation below), and a Domain Authority Boost cannot be cancelled once it has started.

Chargebacks and payment disputes. If you believe a charge is incorrect, you agree to contact us first at billing@fluxwriter.com and allow at least 10 business days to resolve it before initiating a chargeback or payment dispute. A chargeback or payment dispute suspends your Account while we investigate it, and a suspension freezes your Prepaid Balance as Section 11 describes. To answer a chargeback or dispute, we may give the card network, the bank, and the payment provider our records of the purchase, including the record of your agreement to these Terms at checkout, our delivery logs, and your account activity. Initiating a chargeback for a charge that was in fact authorized and for a Service you accessed is a material breach of these Terms. In that event we may immediately suspend or terminate your Account, revoke all Credits and other unused benefits, and end your license to access and use the Service under Section 12, and the disputed amount together with any chargeback or dispute fees charged to FluxWriter or Paddle becomes an immediately due debt that you agree to pay, recoverable by any lawful means including reasonable collection costs. A fraudulent chargeback leads to the suspension or termination of your Account and the recovery of the disputed amount and our costs. Your ownership of Generated Content already produced is not affected. Section 6 means that Content is yours outright (FluxWriter holds no license over it that a chargeback could revoke), so a chargeback ends your access to the Service and leaves the fee owing, rather than making your existing Content unlawful to use.

Immediate supply. When you buy a paid Plan, a deposit into your Prepaid Balance, a Backlink Service, the Domain Authority Boost, or anything else we offer for payment, we begin supplying it as soon as your payment is confirmed or, for a purchase from your Prepaid Balance, as soon as you place the order: your Plan's features and your balance are available to you straight away, and the service you ordered is set in motion. Every checkout we open, and every order you place from your Prepaid Balance, first asks you to agree to these Terms, as described under Right of Withdrawal (EU and UK Customers) below.

Cryptocurrency payments are final and non-refundable except under the exceptions in No Refunds Policy above (where a refund is credited to your FluxWriter balance, unless it is a duplicate charge) or where a refund is required by applicable law. Because blockchain transactions are irreversible, any refund of a cryptocurrency payment that is paid out rather than credited to your balance will be issued by FluxWriter directly (in USD or a USD-equivalent stablecoin, calculated using the USD value of the payment at the time it was received and net of any non-recoverable network or processor fees) rather than by reversing the original on-chain transaction. FluxWriter is not responsible for exchange-rate movements between the time of payment and any refund.

If the renewal price for your Plan will be higher than the price you most recently paid, we (or Paddle on our behalf) will notify you by email at least 30 days before the renewal date, stating the new price and the renewal date. You may cancel before the renewal takes effect to avoid the new charge; if you do not cancel, the renewal at the new price is authorized.

Cancellation. You may cancel your subscription at any time from the Billing page in your account or by emailing billing@fluxwriter.com. Cancellation only stops future renewals; your paid access continues until the end of the current billing period, after which your account reverts to the Free plan. As set out under No Refunds Policy above, cancelling does not entitle you to a refund for the unused portion of a paid period, and unused posts do not carry over.

Right of Withdrawal (EU and UK Customers). If you are a consumer in the European Union or the United Kingdom, you normally have a 14-day right to withdraw from a contract made online. Every checkout we open, and every order you place from your Prepaid Balance, asks you to tick a box agreeing to these Terms before you complete the purchase. By completing checkout and agreeing to these Terms, you ask FluxWriter to start supplying what you bought immediately, and you accept that your 14-day right of withdrawal ends once supply starts. The box is never pre-ticked, and none of them lets you complete the purchase without ticking it; we show it to every customer, wherever they are, because we cannot reliably tell where you are. The agreement you give when you start a backlink campaign or turn on automatic backlinks covers every run and campaign it then buys. Because supply starts as soon as your payment is confirmed or your order is placed, your right of withdrawal ends at that moment. If the law nonetheless treats what you bought as a service that you may still withdraw from until it has been fully performed, you may withdraw, but you must pay for what was supplied up to the time you tell us, in proportion to the full price. A paid Plan bought other than through a checkout we opened for that Plan (see Authorization and auto-renewal above) carries no such agreement: you keep the 14-day right of withdrawal the law gives you for it, and we may stop it from renewing. To withdraw, or if you believe you still hold a right to withdraw, email billing@fluxwriter.com from the address on your account. For a purchase made through Paddle's checkout, Paddle's Buyer Terms also apply.

How we record your consent. When you create an account you must affirmatively agree to these Terms and our Privacy Policy, and we retain a record of that acceptance: the version of each document you agreed to, the date, and the IP address and browser it came from. Each time you tick the box agreeing to these Terms at checkout, we keep a record of it too: the date and time, the exact wording you were shown, the version of these Terms in force, what you were buying, and the IP address and browser it came from.

Promotional codes and discounts. Promotional codes and discounts are issued at our sole discretion and may be limited by account, time period, payment method, or Plan. Only one promotional code may be applied per purchase or renewal; promotional discounts do not stack with one another, with affiliate or partner discounts, or with other offers, and where more than one could apply, only the single highest applicable discount is given. Codes expire on the date stated, have no cash value, are non-transferable, and cannot be applied retroactively or carried over to future billing cycles. We may withdraw, modify, or refuse to honor a code, and may reverse a discount or charge the standard rate, where a code is expired, invalid, or obtained or used in breach of these Terms or our anti-abuse measures.

9. Free Plan and Anti-Abuse

Free Plan. The Free Plan is provided at no charge and is subject to reduced features, quotas, and usage limits as described within the Service. The Free Plan is offered on an "as is" and "as available" basis and may be modified, limited, suspended, or discontinued at any time without notice and without liability to you. The Free Plan is intended to let a single user evaluate the Service in good faith.

Anti-abuse measures. To protect the integrity of the Service and prevent abuse of the Free Plan and promotional offers, we employ anti-abuse checks that may use signals including your IP address, a normalized form of your email address, and a one-way fingerprint of your payment method to detect duplicate or fraudulent registrations. You agree not to create multiple Accounts, use disposable or aliased email addresses, or otherwise attempt to circumvent Free-Plan limits, trial restrictions, or anti-abuse controls in order to obtain benefits not intended for a single user.

Scope of Free-Plan and seat limits. The Free Plan is a free trial. Its post allowance is available only for a limited period after your Account is created, as described within the Service, and ends when that period ends or when the allowance is used, whichever comes first. The allowance applies per Account and, where applicable, per registrable domain you connect; it is not multiplied by connecting additional subdomains, URLs, platform sub-accounts, or sites, it is not renewed, and unused allowance does not carry over or transfer between Accounts. We may treat multiple Accounts that we reasonably associate with the same person, household, organization, payment method, or device as a single Account for the purposes of Free-Plan and promotional limits, and may consolidate, downgrade, or suspend such Accounts. Team seats are limited to the number included with your Plan (the Free and Starter Plans are single-user, with the account owner counting as the one seat); sharing a single login among multiple individuals to avoid purchasing seats is prohibited and is grounds for suspension.

If we reasonably determine that you have abused the Free Plan, exceeded fair-use limits, or attempted to circumvent our controls, we may, in our discretion and without liability, throttle, suspend, downgrade, or terminate your Account and revoke any improperly obtained benefits.

Free trials and introductory or promotional offers are limited to one per person, household, and payment method (card or crypto wallet). We may use a normalized form of your payment method, together with IP and email signals, to enforce this limit. Creating multiple Accounts, or using multiple payment methods or identities, to obtain more than one trial or promotional offer is prohibited and may result in immediate charge at standard rates, loss of the promotional price, or termination.

10. Third-Party Services and BYOK Keys

Third-party services. The Service relies on, and interoperates with, a number of third-party services, including Clerk (authentication), Paddle (subscription billing / Merchant of Record), Ziina (one-time card payments), Cryptomus (cryptocurrency payments), our AI Subprocessors (third-party AI language-model and image providers), your Connected Site hosts, cloud hosting and infrastructure providers, a transactional email provider, privacy-friendly cookieless analytics (Plausible), and, for Backlink Services, third-party link-building networks. Your use of these services through the Service may be subject to those providers' own terms and policies. FluxWriter does not control and is not responsible for third-party services, and their availability or behavior may affect the Service. These services (including WordPress, Shopify, Wix, Webflow, Ghost, Google, Moz, Ziina, Paddle, and our cryptocurrency payment processors) are outside FluxWriter's control, and FluxWriter is not liable for their changes, outages, errors, or decisions, or for their effect on the Service.

Bring Your Own Key (BYOK). Certain features let you supply your own API keys for third-party providers (for example, Semrush, Google Analytics 4, Google Search Console, or your own AI or image-generation provider keys). When you use BYOK, your use of those third-party services is governed by your agreements with those providers, and you are responsible for compliance with their terms, for any usage fees or quotas they impose, and for keeping your keys valid. You authorize FluxWriter to use your keys solely to provide the features you have enabled. FluxWriter is not responsible for charges, suspensions, rate limits, data handling, or other consequences arising under your third-party accounts, and we disclaim liability for the acts and omissions of those providers.

Your responsibility for connections. You are responsible for the keys, tokens, and credentials you connect, including ensuring you have the right to use them and that they do not include another party's confidential information without authorization. We treat connected credentials and keys as sensitive and encrypt them at rest, as further described in the Privacy Policy.

11. Backlink Orders, Prepaid Balances, and Domain Authority Boost

Backlink Services. The Service offers optional Backlink Services that allow you to run backlink campaigns fulfilled through third-party link-building networks. Backlink Services are paid for only from your Prepaid Balance, so you must deposit funds into your Prepaid Balance before placing a backlink order; backlink campaigns are charged to that balance per run at the time each order is submitted for fulfillment. FluxWriter sets the pricing for Backlink Services, and any affiliate commission connected with them is governed by the Affiliate Program Terms. Backlink Services depend on third-party networks and are inherently variable; FluxWriter does not guarantee placement quality, link longevity, indexing, domain metrics, SEO impact, or any specific outcome from Backlink Services. FluxWriter further makes no guarantee that backlink orders will improve rankings, avoid search-engine penalties, or comply with the guidelines or terms of any search engine or platform; purchased links may be detected, devalued, flagged, or penalized by Google or other search engines, and you assume all risk of ranking loss, deindexing, or domain-level penalties arising from your use of Backlink Services.

Credits and Prepaid Balances. Backlink Services, the Domain Authority Boost, and any other feature we offer on the same basis are paid for from a Prepaid Balance that you fund in advance. Every deposit into your Prepaid Balance is final and non-refundable once it is made, whether or not the balance is ever spent, including balance deposited before these Terms were last updated, except where FluxWriter fails to deliver what you paid for (Section 8: the amount is credited to your FluxWriter balance), for a genuine duplicate charge, where a refund is required by applicable law, or, for a deposit made through Paddle's checkout, where a refund is required under Paddle's Buyer Terms. A refund that is paid out rather than credited to your balance goes back to your original payment method: through Ziina or Paddle for a card deposit, whichever processed it, or by FluxWriter directly on the basis described in Section 8 for a cryptocurrency deposit; it is limited to the amount you actually paid and never includes bonus balance added by a promotion, promotional code, or payment-method offer. Credits and Prepaid Balances:

Suspended and terminated accounts. To the extent permitted by applicable law, if your Account is suspended, or is terminated because of your breach of these Terms (including fraud, abuse of the Service or of our anti-abuse controls, or a chargeback or payment dispute described in Section 8), you are not entitled to a refund of any part of your Prepaid Balance, and FluxWriter may retain it to cover the damages, losses, fees, and other amounts you owe us, and as collateral for those amounts. A suspension that begins at or after 20:30 UTC on September 17, 2026 also freezes that balance for as long as the suspension lasts, so nothing can be spent from it and no new deposit into it can be started (a deposit payment you started before the suspension is still credited to that frozen balance); cancels, with immediate effect, every backlink order, backlink campaign, and Domain Authority Boost still running on your Account, and returns the amount paid for each from your Prepaid Balance to that frozen balance; and cancels your Plan subscription immediately, without waiting for the end of the billing period and without any refund or credit for the rest of that period. Lifting a suspension ends the freeze, but does not restore anything the suspension cancelled.

Discontinuation of Backlink Services. If we decide to permanently discontinue Backlink Services, we will give you advance notice. Your balance is not refunded: it stays in your Account and can be used for other FluxWriter services that we offer for payment from a Prepaid Balance.

Failed orders. If a backlink order is submitted to fulfillment and then permanently fails (such that no value is delivered), the Credit spent on that order will be restored to your balance. This restoration of Credit is your sole and exclusive remedy for a permanently failed order; it does not entitle you to a cash refund. Once an order has been submitted to fulfillment, it cannot be cancelled by you. To protect against overspending, the Service may automatically pause campaigns when your balance is too low to fund the next run.

An order is treated as permanently failed only if the fulfillment network confirms it cannot fulfill the order at all, or if no link is placed within 60 days of submission. Variations in link quality, domain metrics, placement, indexing, or longevity (and links that are placed and later altered, removed, or deindexed by third parties) do not constitute a permanent failure and do not entitle you to credit restoration or a refund. Restoration of the spent credit is your sole and exclusive remedy for a permanently failed order.

Domain Authority Boost. The Domain Authority Boost is an optional, separately priced, managed service in which we carry out authority-building work ourselves, in-house, on a single website you nominate, to raise that website's Moz Domain Authority score to 60, normally within 12–18 days. It is a one-time purchase per website, is not part of any Plan, and does not renew. You can pay for it by card (the card payment is added to your Prepaid Balance and the Boost is paid for from it automatically) or directly from your Prepaid Balance. Each website can have only one Boost. The current price is the price shown on the Boost Domain Authority page at the time you order. A Boost cannot be cancelled once it has started (it starts as soon as it is ordered) because the work cannot be undone. The work is 100% safe for your Google rankings, with no penalties.

DA 60 guarantee: lifetime. We guarantee that the nominated website reaches a Moz Domain Authority of 60, and that it stays there: your DA 60 is permanent; it never drops. If the website is below Moz Domain Authority 60 (at the end of the engagement or at any time afterwards), contact us at billing@fluxwriter.com and the full Boost fee is credited to your FluxWriter balance (your Prepaid Balance), once for each Boost. That credit is your sole and exclusive remedy under this guarantee: it is an express exception to the No Refunds Policy in Section 8 and, like a permanently failed backlink order, it restores balance and does not entitle you to a cash refund. If a Boost engagement cannot go ahead or permanently fails, its cost is likewise returned to your Prepaid Balance. A Boost that was paid for by card or cryptocurrency checkout, before Boosts were paid for from the Prepaid Balance, is refunded on the terms that applied when it was bought. We record the website's Domain Authority before the engagement begins and again on completion, and Moz is the sole measure: scores from Ahrefs, Semrush, Majestic, or any other vendor are different metrics and are not used to assess the guarantee.

Conditions. The guarantee assumes the nominated website remains reachable, resolvable, and not blocked to crawlers, that you do not change or redirect the domain, and that the domain is not subject to a search-engine manual action or penalty caused by anything other than our work. Where the domain is unreachable or altered by you such that the work cannot be completed or measured, we may pause the engagement or, at our discretion, refund it to your Prepaid Balance. Domain Authority is a third-party metric published by Moz and recalculated on Moz's own schedule and methodology; the lifetime guarantee above is what covers any change in it. The guarantee covers the Moz Domain Authority score only, not any resulting change in rankings, traffic, indexing, or revenue, which remain subject to Section 16.

12. Intellectual Property and License to Use the Service

FluxWriter IP. The Service, including its software, models, prompts, workflows, user interfaces, designs, text, graphics, logos, trademarks, and all related intellectual property, is owned by FluxWriter or its licensors and is protected by intellectual property and other laws. Except for the limited rights expressly granted in these Terms, no rights, title, or interest in or to the Service are granted to you, and all rights are reserved by FluxWriter and its licensors.

License to you. Subject to your compliance with these Terms and payment of applicable fees, FluxWriter grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business purposes during the term of your subscription. This license does not include any right to copy, modify, distribute, sell, or create derivative works of the Service, except as expressly permitted.

Generated Content. Ownership of Generated Content is addressed in Section 6. Your User Materials and Generated Content are yours; FluxWriter's intellectual property rights extend to the Service itself and not to the Content you produce through it.

Feedback. If you provide suggestions, ideas, or feedback about the Service, you grant FluxWriter a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback for any purpose, without any obligation or compensation to you.

13. Service Availability, Changes, and "As Is" Nature

No service-level guarantee. The Service is provided on an "as is" and "as available" basis. Unless we have entered into a separate written service-level agreement with you, FluxWriter does not guarantee any specific level of uptime, availability, performance, throughput, or response time. The Service may be unavailable or impaired from time to time due to maintenance, updates, capacity constraints, third-party outages, or factors beyond our control.

Changes to the Service. We are continually improving the Service and may add, modify, suspend, or discontinue features, integrations, Plans, quotas, or limits at any time. We may also impose or adjust usage limits for some or all features. Where a change materially reduces the core functionality of a paid Plan you are then paying for, we will make reasonable efforts to provide notice. Your continued use of the Service after a change takes effect constitutes acceptance of the change.

Dependencies on third parties. The Service depends on third-party providers, including AI Subprocessors, payment processors, hosting providers, and Connected Site hosts. Interruptions, errors, rate limits, or changes in these third-party services may affect the availability or behavior of the Service, and FluxWriter is not responsible for issues caused by such third parties.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, our business, or applicable law. When we make material changes, we will update the "Last updated" date at the top of these Terms, post the updated Terms on this page, and notify you by email; we may also show a notice within the Service. Non-material changes may take effect upon posting. Changes to prices and Plans are made with notice, as described in Sections 7 and 8.

Changes will become effective on the date indicated in the updated Terms. Your continued access to or use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may cancel your subscription in accordance with these Terms. Changes to recurring fees will apply to renewals occurring after the change becomes effective and after any notice required by law has been provided.

15. Termination and Suspension

Termination by you. You may stop using the Service and cancel your subscription at any time through the Service or the billing portal. Cancellation stops future auto-renewals; it does not entitle you to a refund of fees already paid except as required by law or as set out in Section 8. You may also request deletion of your Account by emailing legal@fluxwriter.com from the address on the account; deletion is carried out within 30 days, on the basis and with the exceptions described in the Privacy Policy. Cancelling a subscription does not delete your Account or your data.

Suspension and termination by us. We may suspend, restrict, or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe that: (a) you have violated these Terms or any incorporated policy; (b) your use poses a security, legal, reputational, or operational risk to FluxWriter, other users, or third parties; (c) you have failed to pay fees when due, or a payment has been reversed or disputed other than in good faith; (d) you have abused the Free Plan or our anti-abuse controls; or (e) we are required to do so by law or by a third-party provider on which the Service depends. Where practicable and lawful, we will provide notice and an opportunity to cure, but we may act immediately where the circumstances warrant.

Automated suspension and how to appeal. Some suspensions are applied automatically, in particular where a payment is charged back or disputed, or where our anti-abuse checks assess a registration as duplicate, disposable, or abusive. If your account is suspended you will be shown a notice when you sign in, together with the reason where one has been recorded. You may appeal any suspension or termination by emailing appeals@fluxwriter.com from the address on the account. A person reviews every appeal, and where an account was restricted in error we will reinstate it.

Effect of termination. Upon termination or expiration of your Account, your right to access and use the Service ceases. We may delete your User Materials and Generated Content in accordance with our data-retention practices described in the Privacy Policy, and you are responsible for exporting or backing up any Content you wish to retain before termination. Any outstanding fees become immediately due. Provisions of these Terms that by their nature should survive termination (including those relating to ownership, fees owed, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

16. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, INCLUDING ALL GENERATED CONTENT, FEATURES, BACKLINK SERVICES, AND THIRD-PARTY INTEGRATIONS, IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. FLUXWRITER AND ITS SUPPLIERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, FLUXWRITER DOES NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (b) GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, NON-INFRINGING, COMPLETE, OR FIT FOR ANY PURPOSE; (c) ANY SEO, RANKING, INDEXING, TRAFFIC, OR REVENUE RESULT WILL BE ACHIEVED; (d) BACKLINK SERVICES WILL PRODUCE ANY PARTICULAR OUTCOME OR LASTING PLACEMENT; OR (e) DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM FLUXWRITER OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum scope and duration permitted by applicable law. 17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FLUXWRITER OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS, OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FLUXWRITER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLUXWRITER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO FLUXWRITER FOR THE SERVICE DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS CAP APPLIES IN THE AGGREGATE TO ALL CLAIMS AND DOES NOT RESET WITH EACH CLAIM.

THE LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND REFLECT AN ALLOCATION OF RISK BETWEEN THE PARTIES, INCLUDING THE FACT THAT THE FEES CHARGED REFLECT THIS ALLOCATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE, FLUXWRITER'S LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING YOUR RIGHTS AS A CONSUMER UNDER MANDATORY LAW.

18. Indemnification

You agree to defend, indemnify, and hold harmless FluxWriter and its officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Materials, your Generated Content, or your publishing or use of any Content (excluding any claim arising solely from FluxWriter's own gross negligence or willful misconduct); (b) your use or misuse of the Service; (c) your Connected Sites or your use of credentials and BYOK keys; (d) your violation of these Terms or any incorporated policy; (e) your violation of any law or of any third party's rights, including intellectual property, privacy, or publicity rights; or (f) your Backlink Services orders.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You may not settle any claim in a manner that imposes any obligation or admission on FluxWriter without our prior written consent.

19. Governing Law and Dispute Resolution

Governing law. These Terms and any dispute or claim arising out of or in connection with them, the Service, or their subject matter (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Jurisdiction. Subject to any mandatory consumer-protection rights you may have in your country of residence, you and FluxWriter agree that the courts of Dubai, United Arab Emirates will have exclusive jurisdiction over any dispute, claim, or proceeding arising out of or related to these Terms or the Service, and you consent to the personal jurisdiction of, and venue in, those courts.

Informal resolution. Before filing a claim, you agree to first contact us at legal@fluxwriter.com and attempt to resolve the dispute informally in good faith. We will likewise attempt to resolve the dispute with you. Many disputes can be resolved quickly and to the parties' mutual satisfaction this way.

Time to bring a claim. To the extent permitted by applicable law, any claim arising out of or related to these Terms or the Service must be brought within one (1) year after the claim arose; otherwise, the claim is permanently barred. Nothing in this section deprives you of any mandatory protections or rights to which you are entitled under the law of your country of residence that cannot be waived by agreement.

20. Force Majeure

FluxWriter will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond its reasonable control, including acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, government action, embargoes or sanctions, labor disputes, failures or interruptions of the internet or telecommunications, power failures, failures or changes of third-party services, suppliers, or hosting providers, cyberattacks, denial-of-service attacks, or other events of a similar nature. During a force majeure event, FluxWriter's affected obligations will be suspended for the duration of the event, and we will use reasonable efforts to resume performance.

21. Assignment

You may not assign, transfer, or delegate these Terms or any of your rights or obligations under them, in whole or in part, without FluxWriter's prior written consent, and any attempted assignment in violation of this section is void. FluxWriter may freely assign or transfer these Terms and its rights and obligations, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. These Terms bind and inure to the benefit of the parties and their permitted successors and assigns.

22. Severability, Waiver, and Entire Agreement

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

Waiver. No waiver of any term or condition of these Terms will be deemed a further or continuing waiver of that term or any other term, and FluxWriter's failure to assert any right or provision under these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.

Entire agreement. These Terms, together with the Privacy Policy, Disclaimer, Affiliate Program Terms (where applicable), and any other policies or order forms expressly incorporated by reference, constitute the entire agreement between you and FluxWriter regarding the Service and supersede all prior or contemporaneous agreements, proposals, and understandings, whether written or oral, regarding the Service. In the event of a conflict between these Terms and a policy incorporated by reference, these Terms govern unless the policy expressly states otherwise. Any terms imposed by you (for example, in a purchase order) that conflict with or add to these Terms are rejected and have no effect.

23. Electronic Communications and Notices

Electronic communications. By using the Service, you consent to receive communications from us electronically, including by email and through notices posted within the Service. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You are responsible for keeping your email address and contact information current.

Notices to FluxWriter. Legal notices to FluxWriter must be sent to legal@fluxwriter.com. Notices to you may be provided by email to the address associated with your Account or by posting within the Service, and are deemed received when sent (for email) or posted (for in-Service notices).

24. Affiliate Program

If you participate in the FluxWriter affiliate program, your participation is also governed by the Affiliate Program Terms, which are incorporated into these Terms by reference. Among other things, those terms address commission structures, attribution, minimum payouts, payout methods, prohibited conduct such as self-referral and fraud, and clawback of commissions on refunds or chargebacks. In the event of a conflict between these Terms and the Affiliate Program Terms with respect to the affiliate program, the Affiliate Program Terms govern.

25. Copyright Complaints

If you believe that Content generated or published through the Service infringes a copyright you own or control, send a written notice to legal@fluxwriter.com that includes: (1) your name and contact details; (2) identification of the allegedly infringing Content and its location or URL; (3) identification of the copyrighted work you claim is infringed; (4) a statement, made in good faith and under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (5) your physical or electronic signature. We will review valid notices and take appropriate action under applicable law, which may include removing or disabling access to the Content and, in appropriate cases, suspending or terminating accounts of repeat infringers.
